Acceptance
By accepting the Terms of Use and Privacy Policy and registering with MeOnGo Service, you agree to have read, understood, and accepted all the terms and conditions hereinunder ("Agreement"). If you do not agree with any of the terms, please do not proceed to register with MeOnGo Service and do not accept Terms of Use or Privacy Policy.
Eligibility
You should be atleast 18 years old in order to access, register for, and use MeOnGo Service.

Service
MeOnGo is a unique mobile email service offering from Net4Nuts Ltd ("Net4Nuts"). It provides an online service that enables data-enabled mobile devices to work with existing email mailboxes (which may be provided by third party service providers), and vice versa ("Service"). The MeOnGo Service comprises of two parts, an online (web) interface for configuring the service and a mobile component that caters to the mobile device.
In order to use the Service, you must obtain access to the Internet, either directly or through a service provider, and pay service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the Internet, including a computer, mobile phone or other access device.
You understand that the Service at this time in pre-release (beta) mode and undergoing upgrades and revisions.

Proprietary Information
All proprietary information belonging to Net4Nuts or to its business partners or to any third party, including but not limited to, text, trademarks, logos, software, copyright information, and all other information protected by intellectual property right (IPR), would continue to remain the property of respective owners of those information. You are not impliedly or expressly granted any rights or ownerships over any of the proprietary information. Further, you are prohibited from using, copying, publishing, modifying, reverse-engineering, or transmitting these proprietary information in any manner whatsoever.

Modifications to the Service
Net4Nuts may at its sole discretion, and without any prior notice, modify or terminate the Service. Unless explicitly stated otherwise, any new features that augment or enhance the Service including, but not limited to, the release of new Net4Nuts properties, shall be subject to this Agreement. You agree that Net4Nuts shall not be liable to you or to any third party for any such modification or termination of the Service by Net4Nuts. Even if your Service is discontinued, the provisions in this Agreement, related to proprietary information, disclaimer, liability, and indemnification shall continue to apply.

Authorization
The user (you) of the Service authorizes Net4Nuts to access third party email accounts on your behalf to retrieve the information and content requested during the use of the Service. You authorize Net4Nuts Ltd. to legally represent you to your service provider through this interface and you permit Net4Nuts to use information submitted by you (usernames, passwords, email addresses etc.) for the above mentioned purpose. You agree that such information provided by you to Net4Nuts is your signature and authorization for Net4Nuts to serve as your agent to transact with service providers. Each time you use the Service, you are authorizing Net4Nuts as your agent to process your request through or with a service provider. You agree that Net4Nuts shall not be responsible for any acts of any kind with respect to accessing information from any such third party services and any violations, liabilities in connection with such usage will solely be your responsibility.
You also acknowledge, agree and authorize Net4Nuts to disclose your account details and contents if it is necessary:
- To comply with legal process.
- To enforce the Terms of Use.
- To administer the Services
- To respond to claims that any content violates the rights of third parties.
You hereby expressly authorize Net4Nuts to act as your agent and to process your requests for through or with any information provider or service provider.

MEMBER ACCOUNT, PASSWORD AND SECURITY
You will receive a password and account designation upon completing the registration process on the MeOnGo website. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.
You agree to:
- provide true, accurate, current and complete information about yourself as prompted by the registration form ("Registration Data")
- maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
- immediately notify Net4Nuts of any unauthorized use of your password or account or any other breach of security;
- ensure that you exit from your account at the end of each session; and
- accept responsibility for all usage of the Service and any fees associated with use of other services accessed through the service on your account whether or not authorized by you. Net4Nuts cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

User Behavior
You are yourself responsible for all your acts and behavior in course of your using the Service. Using this Service, you agree:
- Not to send unsolicited emails, promotional campaigns or spam.
- Not to send message, picture, or any other material that is obscene, pornographic, vulgar, abusive, racist, or malicious in nature.
- Agree to submit your true information always and not give false or misleading identity.
- Not to spread viruses or try to gain unauthorized access any other user's information.
If Net4Nuts has any reason to believe that you have violated any of the permitted norms for using Service, Net4Nuts reserves the right at its sole discretion to suspend or terminate your account(s).

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE MEONGO SERVICE OFFERED BY NET4NUTS IS AT YOUR OWN RISK. THIS SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. NET4NUTS RESERVES THE RIGHT TO CHANGE THE FLOW, LAYOUT, USER INTERFACE, FUNCTIONALITY, FEATURES OR URL OF THE SERVICE AT ANY TIME. NET4NUTS AND ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
NET4NUTS MAKES NO WARRANTY THAT THE SERVICE: (i) WILL MEET YOUR REQUIREMENTS, (ii) WILL OPERATE UNINTERRUPTED (iii) WILL FUNCTION TIMELY AND ACCURATELY, (iv) WILL BE SECURE, ERROR-FREE, AND VIRUS FREE, (v) WILL BE CORRECTED OF ANY DEFECTS. FURTHER, ( vi) NET4NUTS DOES NOT WARRANTY ANY THRID PARTY MATERIAL ACCESSED BY YOU THROUGH YOUR ASSOCIATION WITH MEONGO SERVICE.
IN COURSE OF YOUR ACCESSING OR USING MEONGO, NET4NUTS WILL NOT BE RESPONSIBLE FOR ANY INFORMATION OR ADVICE, WHETHER ORAL OR WRITTEN, ACCESSED BY YOU, OR FOR ANY GOODS OR SERVICES PURCHASED BY YOU, WHETHER DIRECTLY FROM MEONGO OR FROM ANY THIRD PARTY LINKED TO MEONGO SERVICE.
YOU ALONE WILL BE RESPONSIBLE FOR ACCESSING OR DOWNLOADING ANY MATERIAL, CONTENT, OR SOFTWARE DURING THE USE OF MEONGO SERVICE. ALL SUCH DOWNLOADS ARE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR TO YOUR MOBILE HANDSET OR ANY LOSS OF DATA FROM ANY DEVICE. |
Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT UNDER NO CIRCUMSTANCES SHALL NET4NUTS, ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS BE LIABLE FOR ANY INTERRUPTION OF BUSINESS, OR ANY LOSS OF PROFITS, OR, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES OF ANY KIND, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE), INCLUDING, WITHOUT LIMITATION: DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, HARDWARE, SOFTWARE, MOBILE HANDSET OR COMPUTER, OR OTHER INTANGIBLE LOSSES (EVEN IF NET4NUTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (1) YOUR USE OR YOUR INABILITY TO USE THE SERVICE; (2) ANY BREACH OF THESE TERMS OF SERVICE BY NET4NUTS; (3) MESSAGES RECEIVED AS A RESULT OF YOUR USING THIS SERVICE; (4) UNAUTHORIZED ACCESS TO OR ALTERATIONS TO YOUR TRANSMISSION OR DATA; (5) STATEMENTS, CONDUCT, AND MATERIAL OF ANY THIRD PARTY; OR (6) ANY OTHER MATTER RELATING TO THE SERVICE.
IF YOU ARE DISSATISFIED WITH THE SERVICE, THE SERVICE OR ANY CONTENT ON THE SERVICE, OR WITH THESE TERMS OF SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICES. |
Indemnification
You agree to indemnify, defend and hold harmless Net4uts, its members, employees, officers and directors, or users from and against any and all claims, liabilities, penalties, settlements, judgments, fees (including reasonable attorneys' fees) arising from (i) any content that you or anyone using your account may submit or access via the web site; (ii) your use of the Service, including any data transmitted; and (iii) your violation of this agreement.

TERM
This Agreement will be in effect from the date your completed registration is accepted by Net4Nuts. Either you or Net4Nuts may terminate this Agreement at any time with or without notice. The provisions and all obligations of, and restrictions on you and any user of your account with respect to the Service, shall survive any termination of this Agreement.
You agree that Net4Nuts, in its sole and absolute discretion, may terminate your password, account (or any part thereof) or use of the Service, for any reason, including, without limitation, for lack of use or if Net4Nuts believes that you have violated or acted inconsistently with the letter or spirit of the Agreement. Net4Nuts may, also, in its sole and absolute discretion, and at any time, discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Agreement may be effected without prior notice, and acknowledge and agree that Net4Nuts may immediately deactivate or delete your account and all related information and files in your account and/or prohibit any further access to all files or the Service to you. Further, you agree that Net4Nuts shall not be liable to you or any third-party for any termination of your access to the Service.

Governing Law and Jurisdiction
This agreement, all interpretations and disputes shall be governed by Indian law. Each party submits to the non-exclusive jurisdiction of Ahmedabad, Gujarat.

General
Severability: If any provision of this Agreement is, or becomes, unenforceable, it will be severed from this Agreement and the remainder of this Agreement will remain in full force and effect.
Waiver: No term or provision hereof shall be deemed waived or any breach excused, unless such waiver or consent shall be in writing and signed by the party claimed by the other to have waived or consented. Any consent by any party to, or waiver of, a breach by the other, whether ex-press or implied, shall not constitute a consent to, waiver of, or excuse for any other different or subsequent breach.

Privacy Policy
The privacy concerns have been addressed in Privacy Policy draft. By accepting Terms of Use, you agree to have read, understood and accepted both Terms of Use as well as Privacy Policy.

Rights over your Feedback
Net4Nuts always encourages you to send your feedback on MeOnGo Service. You give Net4Nuts unrestricted, perpetual, irrevocable, royalty-free license to use, copy, publish, exploit any original ideas included in your feedback.

Changes in Terms of Use
Net4Nuts may keep modifying this Terms of Use from time-to-time. Information regarding any change in the draft existing at that point in time will be appropriately posted on MeOnGo website. Moreover, the date of last modification would always be indicated at the top of the Terms of Use draft.

MISCELLANEOUS
This Agreement shall be interpreted according to their fair meaning and shall not be interpreted strictly against or for either party. This Agreement constitutes the entire agreement with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether, electronic, oral or written, between Net4Nuts and the user of this Service. Headings used herein are for convenience only and shall not limit, control or add to the meaning of any term, provision or condition. Net4Nuts may notify user in writing or electronically either of which shall be deemed fully and completely adequate and effective to notify user of the contents therein at the time sent to the last address or email address supplied by user in writing or electronically to Net4Nuts. Use of the plural herein shall include the singular and use of the singular shall include the plural.
